Returns or Exchanges
- The reseller is responsible for returning the Faulty Item.
- Returned Faulty Items will be credited to the Reseller within 60 days.
- A refund is only available if a returned Faulty Item retains the manufacturer's tag on the clothing.
- Faulty Items are returned to the Supplier at the Reseller's expense.
- The Supplier will not accept the return of unsold Products except where the Products are Faulty Items.
- A product is not a "Faulty Item" by virtue only of the fact that it is not popular with potential Customers.
Missing stock
The Reseller is responsible for confirming that the correct quantity of Product has been delivered in response to an order. If the Reseller determines that there are missing items in an order, it must notify the Supplier within 5 Business Days from the date upon which the Product is delivered to the Reseller's warehouse or other nominated delivery point. The Supplier may require such evidence as is reasonable in the circumstances to verify the deficiency.
No guarantee of availability
The Supplier does not represent or guarantee that Products will be available upon demand or at all. The Supplier will advise the Reseller as soon as practicable if a Product becomes temporarily or permanently unavailable.
Warranty and Disclaimer
- To the extent permitted by law, any condition or warranty which would otherwise be implied into this Agreement is hereby excluded
- The application of the United Nations Convention on Contracts for the International Sale of Goods (the Vienna Convention) to this Agreement (by virtue of any law relevant to this agreement) is excluded.
